Temporary Work Visas for Professionals and Non-Professionals

Temporary or "nonimmigrant" work visas allow foreign nationals to enter the United States on a temporary basis to perform services in the United States. In some cases foreign nationals who are in the United States as temporary workers may qualify to later adjust their status to that of lawful permanent residents:

  • H-1B Visas: these visas are designed for foreign nationals to come to the U.S. to perform services at a professional level. A company in the U.S. must file a petition with the U.S. Citizenship and Immigration Services on behalf of the foreign national which, if approved, is forwarded to the U.S. consulate abroad where the foreign national applies for an H-1B visa. The visa allows for the foreign national to be admitted for an initial period of 3 years and the status may be extended in the United States for up to 6 years, and possibly longer in certain cases. Foreign nationals in the United States in valid H-1B status may in certain cases apply to adjust their status to that of a lawful permanent resident. Current law limits the number of H-1B visas issued to 65,000 annually, which in recent years has been insufficient to meet the demand for these types of visas. As a result, in recent years because of the large number of H-1B petitions filed, visas have been issued by selecting petitions to be processed on a random lottery-type basis.
  • H-2B Visas: these visas allow foreign nationals temporarily to enter the United States to perform non-professional services of a temporary nature. H-2B visas are used primarily for seasonal workers, working in landscaping, agriculture or other jobs that require a temporary workers. Prior to filing a petition with the U.S. Citizenship and Immigration Services a prospective employer seeking an H-2B visa for a foreign national must first file an application for temporary employment certification with the U.S. Department of Labor.
