Representation in Removal Proceedings for Criminal and Non-Criminal Foreign Nationals
In 1996, the Antiterrorism and Effective Death Penalty Act (AEDPA) was passed by Congress and signed into law by President Bill Clinton. That law eliminated several forms of relief from deportation previously available to foreign nationals, including lawful permanent residents, placed in deportation proceedings as a result of a criminal conviction.
Representation by competent immigration counsel in these types of proceedings is critical to insure that the foreign national avails himself of any and all relief available under current law. In many cases relief is still available, and it is important to identify at the earliest possible time what relief is available and to take steps to seek the relief before the immigration court. Unfortunately, in some cases the only relief available is relief under the U.N. Convention Against Torture. Foreign nationals, including lawful permanent residents, facing criminal charges should consult with competent immigration counsel prior to entering a plea in the criminal court.
Foreign nationals present in the United States without legal status but who have not been convicted of any crimes also face new challenges under current Department of Homeland Security enforcement programs. Many of the foreign nationals against whom removal proceedings are commenced are long-time law-abiding residents of the United States who have histories of steady employment, have paid their taxes, have U.S. citizen children and have made significant contributions to their communities. With the help of an experienced immigration attorney, these foreign nationals can apply for a number of waivers available to them as relief from deportation.
