Program Electronic Review Management (PERM) Labor Certification

In requiring employers to file for PERM labor certification, the U.S. Department of Labor's primary goal is to make sure that American citizens receive first preference for American jobs. As a result, before an employer may petition the U.S. Citizenship and Immigration Services to allow a foreign national to obtain lawful residence ("green card status") in the United States the employer must satisfy the U.S. Department of Labor that substantial efforts have been made to find American workers. Only if the Department of Labor is satisfied that there are no U.S. workers qualifying, willing and able to perform the duties of the offered employment and that employment of the foreign national will not adversely affect the wages and working conditions of U.S. workers will an application be approved.

Employers must offer foreign workers for whom a PERM is filed prevailing wages, removing any economic incentive they may have to prefer foreign workers over U.S. workers. Employers must also demonstrate to the U.S. Citizenship and Immigration Services that they have the ability to pay the offered wage by producing tax returns or other financial documents.
